FUNCTION OF THE OWNERS ASSOCIATION ( HOA )

The HOA ’s main functions other then ensuring compliance with the rules is to ensure and maintain the communal property thereby ensuring that the property values are maintained taking market conditions into account.

The Meadowview HOA does not accept any liability for any bodily injury or an nature occurring to any persons on its property howsoever caused and any motor vehicles , household goods, or personal possessions on or in the property of Meadowview are at the sole risk of the Owners thereof , nothing excluded.

Words denoting the singular shall include the plural and word denoting the masculine shall include the feminine.

DEFINITIONS

• Common Areas: Any area not zoned as an exclusive area.
• Complex: The entire are of the development known as Meadowview , inclusive of all areas designed for general and/or exclusive use, and including the boundary walls of the complex.
• Property: Any area owned by the residents of any one particular house and erf.
• Owner: The legal holder of title of any immovable property. Whether a natural of legal persona, and all persons individually who comprise any legal persona.
• Residents: All persons residing within the complex, whether owner or lessee.
• Rules: This document
• Home: The area comprising the building, including the patio or balcony, carport/s, and garden, if applicable, of an owner and boundary walls
• Vehicles: Any transport related item, including but not restricted to cars motorcycles, light commercial vehicles, caravans, boats and trailers.

The clause heading have been inserted for reference purposes only and shall not be taking into account in any interpretation.

Whether you are an owner or a tenant, you remain a member of our community and have a responsibility towards your neighbors the buildings and equipment of the complex. Therefore you are asked to CO-OPERATE AT ALL TIMES AND TO PROMOTE GOOD NEIGHBOURLINESS.


1. CHANGE OF OWNERSIP AND RESIDENTS

1.1. Where residents change , the HOA Chairman is to be notified in writing one week before occupation, by the owner , of the new names and their vehicle registration numbers. A confirmed fax is acceptable.
1.2. The owner is responsible for the conduct of his residents. He must ensure that they have a copy of the rules and agree to abide by them.
1.3. Likewise, a owner must obtain a copy of the rules form the previous owner or the HOA Chairman and abide by them.

2. LETTING OF THE HOUSE AND CARPORTS

2.1. The terms and conditions upon which owners may let their houses garages and carports, whether trough a Agent or otherwise, shall include an acknowledge by the Lessee of the existence of these Rules and an undertaking by the Lessee to adhere to them.
2.2. Any breach by the Lessee of any of the provisions in terms of section 21 of the Companies Act, 1973, the regulations promulgated there under, the Management Rules and the Conduct Rules shall be a breach of the Lease.
2.3. The HOA committee reserves the right to require Owners to give notice to tenants who continue to breach these rules.

3. NUMBER OF OCCUPANTS

3.1. The maximum permissible number of occupants per house residents is:
  • Two bedroom : 4
  • Three bedrooms : 6
  • Four bedrooms: 8

4. DAMAGE TO PROPERTY

4.1. Upon any new resident taking occupation of or vacating a house, any cost of repairing any damage to any common property in the complex caused by the moving of furniture or any other goods in or out of the complex, shall be paid by the owner of the house. In the event of an owner having leased his unit, the HOA shall still hold the owner liable for such costs and it shall be incumbent the owner to recover any such costs for his tenant.
4.2. The general appearance and state of repair of the property and the gardens of Meadowview are a decisive factor in the individual value of the units and any willful damage or defacement of the property will result in immediate prosecution of the party involved.

5. RESIDENTS EMPLOYEES

5.1. Residents and contract workers shall not allow their employees to congregate in the public areas of the complex not to have meals in such public areas, or cause undue notice on the common property or elsewhere.
5.2. Separate toilet facilities for employees are not available.

6. PARKING OF ANY VEHICLE/TRAILER/BOAT ETC.

6.1. No owner shall park or stand any vehicle upon the common property, or permit or allow any vehicle to be parked or stood upon the common property, without the consent of the trustees in writing unless used regularly, excluding the "visitor" parking for the exclusive use by visitors.
6.2. The HOA may cause to be removed or towed away, at the risk and expense of the owner of the vehicle, any vehicle parked, standing or abandoned on the common property without the HOA consent.
6.3. Owners and occupiers of units shall ensure that their vehicles, and vehicles of their visitors and guests, do not drip oil or brake fluid on to the common property or in any other way deface the common property.
6.4. Car washing: the use of fire hydrants is explicitly prohibited. Unlawful use of fire hydrants can result in fines of R2000,00 from the City Council.
6.5. Parking is subject to the express condition that vehicles are parked at the parker's risk and responsibility.
6.6. No vehicles should be parked on the driveways outside or inside the complex, or on the pavement, so as to block entrances or passages to either motor vehicles or pedestrians.
6.7. A speed limit of 20km per hour will be strictly applied within the perimeter of the common property. Vehicles must leave or enter as quietly as possible, and this applies especially to motorcycles, as these have a particularly disbursing effect. Vehicles accessing Meadowview should not exceed the speed limit of 20km per hour and shall therefore not speed up and down this access driveway.
6.8. Caravans, boats, canoes or similar items may not permanently or temporarily occupy any parking bay.

7. ELECTRICAL SUPPLY AND PLUMBING

7.1. Under no circumstances may residents tamper with or have work done on the electrical apparatus or plumbing which serves the common property. Any electrical or plumbing faults detected on the common property must be reported to the HOA Committee member responsible for maintenance. Any problems within the home, (including the geyser) are for the owners repair and account, and not the HOA.

8. FIRE PROTECTION

8.1. Residents are strongly advised to acquire a fire extinguisher and keep it in an easily accessible place in the home. Residents are NOT covered for the contents of their home by the insurance policy taken out on the common buildings and are therefore advised to take out suitable insurance cover.
8.2. Electrical Supply:
Under no circumstances may residents tamper with or have work done on the electrical apparatus, which serves the common property. Any electrical faults detected on the common property must be reported to the HOA.
8.3. Open fires/braai’s:
These are prohibited in the common property, except where facilities have been provided. Matches and lighters should be handled with care and kept out of reach of children. It is strictly prohibited to throw cigarette stubs out of windows or over balconies as this could start a fire. All inflammable liquids must be kept in a safe place.

9. WALLS

9.1. Nails and hooks may not be knocked into common property walls i.e. outside boundary walls. When defects are seen in the walls, they are to be reported to the HOA Maintenance Committee member.

10. REFUSE DISPOSAL

10.1. An owner or occupier of a unit shall:
  1. Maintain in a hygienic and dry condition, a receptacle for refuse within his unit and his exclusive area or on such of the common property.
  2. Each owner/occupier to place their own refuse bag, in the refuse bins provided.
  3. Ensure that before refuse is placed in such receptacle, it is securely wrapped, or in case of tins or other containers, completely drained. Cardboard boxes are to be flattened and placed in the refuse area.
10.2. Persons leaving rubbish on any part of the common property or public sections surrounding the property, or in the entrance to the refuse are liable to prosecution and such offenders must be reported immediately.

11. PETS

11.1. Owners must ensure that their pets are not a nuisance to other owners or tenants.
11.2. No animals are allowed on the common property at any time, unless on a leash and accompanied by the owner. Any animal found unaccompanied on the common property will, if possible, be returned to the owner. ANY LITTER CAUSED BY AN ANIMAL MUST BE CLEARED AWAY BY THE OWNER IMMEDIATELY.

12. CONDUCT

12.. At all times, residents, their employees and visitors shall conduct themselves about the property and in their units in an orderly manner so as not to breach these rules or infringe the rights of other residents. The adherence of employees and visitors to these rules are the responsibility of the residents/owners.

13. PAYMENT TO THE HOA OF LEVIES

13.1. All levies and other miscellaneous debits are due and payable on or before the 7th of each month.
13.2. All other levy issues will be addressed in accordance with the Meadowview Constitution.
